Welcome to SeeGuest, a service provided by Wtech Consulting LLC doing business as SeeGuest ("SeeGuest," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our omnichannel SaaS platform, websites, and related services (collectively, the "Service").
By using the Service, you ("Customer," "you," or "your") agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement.
You must create an account to use the Service. You agree to provide accurate and complete information and to keep your account credentials confidential.
You agree to use the Service only in accordance with applicable laws and these Terms. You may not:
You retain all rights to data you upload or generate through the Service ("Customer Data").
You grant SeeGuest a limited license to access, store, process, and transmit Customer Data as necessary to provide and improve the Service.
You are solely responsible for obtaining appropriate consents from your guests and staff before processing their personal data through the Service.
Access to the Service may require payment of fees. Pricing, billing cycles, and payment terms are specified in your agreement or subscription plan. Failure to pay may result in suspension or termination of the Service.
The Service and all related intellectual property are owned by SeeGuest or its licensors. You are granted a non-exclusive, non-transferable license to use the Service as permitted under these Terms.
Each party agrees to protect the other's confidential information and to use it only for the purposes of fulfilling this agreement. This obligation continues even after termination.
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not guarantee uninterrupted or error-free service.
To the maximum extent permitted by law, SeeGuest is not liable for indirect, incidental, or consequential damages, including loss of profits or data. Our total liability under these Terms is limited to the amount paid by you in the past 12 months.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service will cease and we may delete your data, subject to applicable law and our data retention policy.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Your continued use of the Service constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict of law principles. Any disputes will be resolved in the courts of Albuquerque, New Mexico.
